WARNING: Because the growth of the Internet has been faster than the laws that protect its content, some of the legal issues regarding the use of this content are still being considered by courts of law including the doctrine of Fair Use. However, it is generally accepted that you may download and save for either personal or educational use the small thumbnail photos that you've found on the Internet without asking permission first or paying a licensing fee. So far, the courts have not determined the exact size of the thumbnail, but it is somewhat understood to mean that a thumbnail is an image that is 194x130 pixels in size or smaller. For larger images or any text found with the thumbnails, Fair Use does not apply. Also, you can not consider any commercial use or any use that prevents the copyright owner from receiving the value of or the market for the original photo as Fair Use. When in doubt you should check with the person or organization that added the photo to the website. Occasionally, a photo contributor allows the use of the images without prior permission but you should always check with them first.
Sometimes it is better just to refine your searches to photo and clip art sites which offer images in the Public Domain, with Creative Commons Licenses, or the databases provided by FBISD. However, even with these, you must include a citation for each image you use. DO NOT BE GUILTY OF PLAGIARIZING!! YOUR TEACHERS WILL KNOW, and the use of plagiarized materials can have serious consequences!
